CRMBC Energy Program First Quarter 2010 Update

OVERVIEW
More than 400 restaurants are now buying their natural gas and/or electricity through the CRMBC Energy Program. Thanks!

INVITATION TO ONLINE WEBINAR
In order to keep you fully informed about the Energy Program as well as the energy markets and your opportunities, Aviva Energy will host an online Webinar every other month. The next Webinar will be held on Thursday April 8 at 9 a.m. Pacific Time.

The session will include a twenty minute presentation followed by plenty of time for questions and answers. You will receive an invitation by email in the next few days. Please be sure to RSVP to assure that you have a place at the Webinar on April 8. If necessary, we will schedule additional times should there be demand.

Copies of the presentation as well as a summary of the Q&A will be provided to all participants and interested parties. We look forward to meeting with each of you online on April 8.

NATURAL GAS
The initial group of 250 facilities is now purchasing natural gas from the winning bidders - Constellation NewEnergy in PG&E territory and Sierra Southwest in southern California.

The Energy Program is continuously enrolling new restaurants for gas and power. Three or four times per year, we solicit bids from suppliers for the new members and for renewal contracts. There are about 60 facilities awaiting the next natural gas offer that will be conducted in April. If you have already signed-up but not yet switched to a new supplier, you will receive a packet by email with your new contract offer in late April.

Please include both sides of all pages of the utility bills for both natural gas and electricity. Call or email Aviva Energy if you have any questions. If you have already provided this information to Aviva, you do not need to resubmit.

In June, the first “Natural Gas Price Analysis Report” will compare the prices paid by members of the CRMBC Energy Program to the monthly prices of the prior suppliers and the cost of gas from the utilities.

FIXED PRICE OFFER
The price of natural gas and power are near 6-year lows. Aviva Energy expects that energy prices may continue downward for a few more weeks until a consensus emerges on the direction of the economy, inflation and industrial energy demand.

The Energy Advisory Committee of CRMBC has authorized Aviva Energy to seek fixed price offers from the preferred natural gas and upcoming electricity suppliers. Because of the large number of members, and in order for you to have as much time as possible to respond to the offers, we will probably set-up the procedure as a “trigger price authorization.”This will allow you to instruct your supplier to lock-in your contract at the pre-approved price if the market moves to that price during a specified period of time.

Details on locking-in prices will be discussed at the Webinar on April 8 beginning at 9 a.m.

DIRECT ACCESS ELECTRICITY
As you probably know, in a few weeks California is re-opening Direct Access on a limited basis. Aviva Energy is in the process of collecting data from interested members of the CRMBC Energy Program.

If you are interested in becoming a Direct Access customer, please submit your data by clicking www.AvivaEnergy.com/contract or fax a copy of a recent utility bill for each location to (888) 646-3355. Please include both sides of all pages of the utility bills. If you have already provided this information to Aviva Energy, you do not need to resubmit.

The forms required by the utilities are scheduled to be published by April 2. During the week beginning April 5, Aviva Energy will ask each interested Energy Program member to confirm certain utility Service Account information and to sign the appropriate forms to authorize Aviva Energy to act as your agent in the process.

On April 16, Aviva Energy will submit a, ‘Notice of Intent’ on your behalf to apply to enter the Direct Access electricity market. The utilities will accept accounts on a, ‘first come first served’ basis up to the kilowatt hour Cap. We will be notified by the utilities in late April of the accounts that were accepted into Direct Access. Accepted accounts will then have 60 days (ending about June 30th) to analyze prices and tariff issue as well as decide whether to sign electricity supply contracts.
